1. Acceptance of Terms

By accessing our website (https://www.sherwoodparkwindows.com/), requesting a quote, or using our services, you ("Customer", "you", or "your") agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or services.

These Terms & Conditions constitute a legally binding agreement between you and Sherwood Windows Ltd. ("we", "us", "our", or "Company").


2. Services Description

Sherwood Windows Ltd. provides the following services in Sherwood Park, Alberta and surrounding areas:

  • Window replacement and installation
  • Door replacement and installation
  • Window and door repairs
  • Glass replacement
  • In-home consultations and measurements
  • Product selection assistance
  • Post-installation support and warranty service

3. Quotes & Estimates

Quote Validity

All quotes and estimates are valid for 30 days from the date of issue. After this period, pricing may be subject to change due to material cost fluctuations, supplier pricing changes, or other factors beyond our control.

Quote Accuracy

Quotes are based on information provided by the customer and preliminary site assessments. We make every effort to provide accurate estimates, but final pricing may be adjusted if:

  • Site conditions differ from initial assessment
  • Additional work is required (structural repairs, framing modifications, etc.)
  • Customer requests changes to product specifications or project scope
  • Unforeseen complications arise during installation

Non-Binding Estimates

Initial estimates provided over the phone or email are approximate and non-binding. Final pricing is confirmed after an in-home consultation and measurement.

Written Quotes

All formal quotes will be provided in writing (email or physical document) and include:

  • Itemized product costs
  • Labor costs
  • Applicable taxes
  • Expected timeline
  • Payment terms
  • Any exclusions or limitations

4. Pricing & Payment Terms

Pricing

All prices are quoted in Canadian Dollars (CAD) and include applicable GST unless otherwise stated. Prices do not include permits, disposal fees, or additional structural work unless specifically noted in the quote.

Deposit

A deposit of 50% of the total project cost is required to:

  • Secure your installation date
  • Order custom products from our suppliers
  • Reserve our installation crew

Deposits are due within 7 days of quote acceptance. Projects will not commence until the deposit is received.

Final Payment

The remaining balance is due upon completion of the installation and your satisfaction with the work. We accept the following payment methods:

Late Payment

If payment is not received within 14 days of project completion, we reserve the right to:

  • Charge interest at a rate of 2% per month on the outstanding balance
  • Suspend warranty coverage until payment is received in full
  • Pursue collection through legal means

Financing

If third-party financing is arranged, it is the customer's responsibility to ensure approval and payment terms are met. We are not responsible for financing denials or changes to financing terms.


5. Scheduling & Cancellations

Scheduling

Installation dates are scheduled based on product delivery timelines and crew availability. We will provide you with an estimated installation window at the time of quote acceptance.

Weather Delays

Outdoor installations may be delayed due to inclement weather conditions that affect product integrity or installation quality. We will reschedule at the earliest available date at no additional cost.

Customer Cancellations

Before Product Order: If you cancel before we order custom products, your deposit will be refunded minus a $150 administrative fee.

After Product Order: If you cancel after custom products have been ordered, you forfeit your deposit. Custom-ordered windows and doors cannot be returned or restocked.

Within 48 Hours of Installation: If you cancel or reschedule within 48 hours of your scheduled installation date, a $200 rescheduling fee will apply.

Company Cancellations

We reserve the right to cancel or reschedule your installation if:

  • Site conditions are unsafe for our crew
  • Customer has not prepared the site as agreed
  • Payment terms have not been met
  • Weather conditions make installation inadvisable

We will make every reasonable effort to reschedule at the earliest opportunity at no additional cost to you.


6. Installation Terms

Site Access

Customer must provide:

  • Clear and safe access to all installation areas
  • Adequate parking for our vehicle and trailer
  • Access to electrical outlets (if required)
  • Removal of furniture, window treatments, and decorations near work areas

Site Preparation

Customer is responsible for:

  • Moving furniture and personal belongings away from installation areas (we recommend 3 feet clearance)
  • Removing existing window treatments (blinds, curtains, etc.)
  • Protecting flooring with drop cloths or tarps (we will also provide protection)
  • Securing pets and ensuring children are away from work areas
  • Providing access to water if needed

Installation Process

  • We will protect your home with drop cloths and tarps
  • We will remove and dispose of old windows/doors (disposal fees may apply)
  • We will clean up debris and vacuum work areas upon completion
  • We will conduct a final walkthrough with you to ensure satisfaction

Installation Timeline

Most residential window installations are completed within 1-2 days depending on project size. Door installations typically take 4-6 hours per door. We will provide a more specific timeline in your quote.

Unforeseen Issues

If we encounter structural issues, rot, water damage, or other complications during installation, we will:

  • Stop work and consult with you immediately
  • Provide a written estimate for additional repairs
  • Obtain your approval before proceeding with extra work
  • Adjust the timeline if necessary

Additional work discovered during installation is billed separately and is not covered under the original quote.


7. Warranties

Product Warranties

All windows and doors come with manufacturer warranties from our suppliers (Lux Windows, Madero Doors, etc.). Warranty terms vary by product and manufacturer. We will provide you with warranty documentation at the time of installation.

Product warranties typically cover:

  • Glass seal failure
  • Hardware defects
  • Manufacturing defects

Product warranties do not cover:

  • Damage caused by improper use or maintenance
  • Damage from extreme weather events (hail, windstorms, etc.)
  • Normal wear and tear
  • Cosmetic issues that do not affect functionality

Workmanship Warranty

We warrant our installation workmanship for 2 years from the date of installation. This warranty covers:

  • Installation defects
  • Air or water leakage due to improper installation
  • Hardware adjustment issues

Our workmanship warranty does not cover:

  • Normal settling of the home or building
  • Damage caused by customer or third parties
  • Modifications made to the installation by others
  • Neglect or lack of maintenance

Warranty Claims

Warranty service will be provided within a reasonable timeframe based on the nature of the issue and our schedule availability.

Warranty Conditions

Warranties are void if:

  • Payment has not been received in full
  • Unauthorized modifications have been made
  • Products have been damaged due to misuse or neglect
  • Regular maintenance has not been performed

8. Limitation of Liability

Our Liability

To the maximum extent permitted by law, Sherwood Windows Ltd.'s total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific project in question.

What We Are Responsible For

We are responsible for:

  • Providing quality products and professional installation
  • Correcting defects in our workmanship during the warranty period
  • Conducting business in accordance with industry standards
  • Honoring our contractual commitments

What We Are Not Responsible For

We are not responsible for:

  • Pre-existing conditions: Structural issues, rot, water damage, or code violations existing before our work
  • Consequential damages: Loss of use, lost profits, or indirect damages
  • Third-party damage: Damage caused by other contractors, homeowners, or natural events
  • Building permits: Customer is responsible for obtaining necessary permits unless otherwise agreed in writing
  • HOA/Condo approval: Customer is responsible for obtaining approval from homeowners associations or condo boards
  • Interior/exterior finish work: Touch-up painting, stucco repair, siding repair, or drywall repair beyond what is necessary for proper installation
  • Landscaping: Damage to lawns, gardens, or landscaping (we will make reasonable efforts to avoid damage)
  • Utility damage: Pre-existing or hidden utility lines (customer should arrange for utility locates if necessary)
  • Product defects: Manufacturing defects are covered under manufacturer warranties, not by Sherwood Windows Ltd.

Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (extreme weather, natural disasters)
  • Government restrictions or regulations
  • Supplier delays or product shortages
  • Labor disputes
  • Pandemics or public health emergencies

9. Customer Responsibilities

By engaging our services, you agree to:

  • Provide accurate information about your property and project requirements
  • Ensure legal authority to make changes to the property (homeowner or authorized agent)
  • Obtain necessary permits if required by local building codes
  • Prepare the site as outlined in Section 6
  • Be present or have an authorized representative present during installation
  • Inspect the work upon completion and report any concerns immediately
  • Provide timely payment according to agreed terms
  • Maintain products according to manufacturer recommendations
  • Allow reasonable access for warranty service if needed

10. Changes to Project Scope

Change Orders

Any changes to the project scope after the quote has been accepted must be documented in writing as a change order. Change orders may affect:

  • Total project cost
  • Installation timeline
  • Product specifications

Additional Work

If additional work is required during installation (structural repairs, framing modifications, etc.), we will:

  1. Stop work and consult with you
  2. Provide a written estimate for the additional work
  3. Obtain your written approval before proceeding
  4. Document the change order

You are not obligated to approve additional work, but we may be unable to complete the installation if necessary repairs are declined.


11. Dispute Resolution

Mediation

If we cannot resolve a dispute through direct communication, both parties agree to attempt mediation before pursuing legal action. Mediation costs will be shared equally.

Governing Law

These Terms & Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any legal disputes will be subject to the exclusive jurisdiction of the courts of Alberta.

Arbitration

If mediation fails, disputes may be submitted to binding arbitration in accordance with the Arbitration Act (Alberta). The arbitration will take place in Sherwood Park, Alberta.


12. Intellectual Property

Project Photos

We may take photos of our work for quality assurance, documentation, and marketing purposes. By using our services, you grant us permission to:

  • Photograph the installation process and completed work
  • Use photos on our website, social media, and marketing materials
  • Share photos with our suppliers and partners

If you prefer that we not use photos of your project for marketing purposes, please inform us in writing before installation begins.

Testimonials & Reviews

We may use customer testimonials and reviews (with your name or initials) for marketing purposes. You may request removal of your testimonial at any time by contacting us.

Company Materials

All quotes, designs, proposals, and other materials created by Sherwood Windows Ltd. remain our intellectual property. You may not reproduce or share these materials without our written permission.


13. Website Use

Acceptable Use

When using our website, you agree to:

  • Provide accurate information in all forms and communications
  • Not use the website for any unlawful purpose
  • Not attempt to gain unauthorized access to our systems
  • Not transmit viruses, malware, or harmful code
  • Not scrape, copy, or reproduce website content without permission

Website Availability

We make reasonable efforts to keep our website available 24/7, but we do not guarantee uninterrupted access. We may suspend access for maintenance, updates, or technical issues.

16. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.


17. Entire Agreement

These Terms & Conditions, together with any written quotes or contracts, constitute the entire agreement between you and Sherwood Windows Ltd. regarding our services. They supersede all prior communications, agreements, or understandings, whether oral or written.


18. Waiver

Our failure to enforce any right or provision of these Terms & Conditions does not constitute a waiver of that right or provision.
